    Average Medtronic Settlement Is $33,000 Dollars

    Somewhat coincidentally, I drove past a Medtronic facility the day this was announced.   

    “Medtronic is pleased we were able to negotiate terms that were mutually agreeable to the parties,” Christopher Garland, a company spokesman, said in a telephone interview. The settlement covers about 8,100 cases, or “virtually all” U.S. claims, Garland said.

    The settlement resolves cases in both federal and state courts.

    $33,000 Average Payout

    It will provide an average payout of more than $33,000 to patients who have defibrillators with wires that have broken or are considered likely to break. The amount will depend on the extent of the injuries and defects.

    My settlement offer was about 600.00 after attorneys and any other funds went for future medical and would be
    used to pay back medicare and not me. I REJECTED IT.

    This doesn't sound right. My attorneys tell me that they have not started any offers yet. Sounds like this is not an attorney close to the case. If you have not had a fracture and are just able to register, after expenses 600.00 dollars maybe an amount that people just registering may get. I think Tony needs someone to steer him properly.

    We haven't heard anything from our attorneys since end of January and they just wanted more forms signed. They never answer emails, phone calls or return them after we leave messages. Only communication is through letters and what THEY want us to sign with no answers to any questions we have. This was for a relative who passed away due to these defective POS defibrillators, he had 2 put in within 9 months of each other, both were defective. The second one, they couldn't remove even though it didn't work due to his condition. The family is pissed, but now something is better than nothing. The lawyers in our crap town wouldn't touch his case, advised us to take whatever they offered and forget about it.

    $33,000 average....shit $10,000,000.00 is chump change and STFU money compared to what these crooked a$$ lawyers are gonna get and what Medtronic should have paid per case.

    Look at Medtronic's stock value....investors laughed when the settlement went in, the stock soared because they got off. Anyone in the lawsuit got crap. Anyone not accepting will not survive a lawsuit cause Medtronic's pockets run deep, they will get it held up in court for years.

    I am having the same issues, but I have had no correspondence with my attorney either except for an e-mail I sent her 3 weeks ago asking why hadn't we heard anything since the end of Nov. She said she would be sending something out within the next week or so. Still nothing.
    Her excuses were that some attorneys had not gotten in their paper work to Medtronic and that took longer than expected. Hell it was my understanding that if you didn't have everything back by Dec 1 you were out of luck. SOMEBODY IS LYING.

    The $33,000 comes from the total amount of $268,000,000.00 divided by the 8100 estimated cases/claims.....$33,086.41 average per claim before lawyers, medi-crooks, etc.
    So, each case is individual, but we're hoping for the best.

    Well I finally sent my attorney another e-mail and asked what was going on. She responded that they have extended the cut-off to May2,2001from the original Dec. 1, 2010. I don't understand how they can make an extension that long unless Medtronic wanted too because they did not have enough people to agree to the settlement. I know a lot of people did not agree with Medtronic's proposal but it was going to be a long time before you got anything else. She believes that amounts will be finalized by the end of July with awards within a couple of months. When people heard that 600.00 dollar figure, they were not pleased. But if you have not had a fracture that's about all its going to be after attorney's fees. If you didn't die, you ain't getting much. And come to think of it, if you died you ain't getting anything.

    I suffered two lead fractures ten months apart. I spoke to my law office and was told that quite a few attorneys with clients involved in this settlement did not have all their paperwork submitted on time and that the judge gave them a drop dead date of March 25, 2011 to have everything in or they would be out of luck. I was also told that the number of plaintiffs involved in this settlement is now 16,000.

    This is my exact repy as written by my attorney on 3-18-2011

    "I apologize for the delay. Unfortunately, there is not much to report. The claims deadline has been moved to May 2. After that date, the claims review committee will start reviewing all claims. This process will take at least 2-3 months. We currently anticipate that award notices will go out in late summer or early Fall and then payments will be made shortly thereafter."

    If your attorney told you something different, one of us has a big problem with our attorney.
    Just trying to sort out the facts.

    There is so much BS going on and on and on. I am one of the wives that watched her husband being tortured by the broken lead into his heart. He was shocked time and time again...doctor's just stood there and watched it happening. It took them hours to get a donut magnet to stop the shocking. Why did the ER not have the proper instruction and device availabe during these emergencies..... Don't you wonder how a company as large at Medtronic could overlooki such a thing.
    God help all of us.

    Lets not be to naive here. Any pile of money sitting anywhere is the perfect scenario for any number of attorney's.
    They will delay this settlement until every one of us dies and then will try to steal the money from our families.
    Fortunately, they are not getting any younger either and hopefully they will beat us to the grave.
    I have to laugh when my attorney said 33% [standard with most] plus,plus, plus any other expensis he can conjer up.
    Let me see that will be $33,000 for printing fees and such, I'm sure.
    I hope they save enough money for postage to send us a letter telling us we not getting POOOOOP.. sorry.
    I worked for an attorney once who had a widow trying to get at her $14 million estate.
    I overheard the attorney saying that he was going to take as much time as possible and to get as much of the $14 million dollars from her account to his account. [ typical ]

    I am very sad but more confused. I am a single deaf mother of a 5 years old. I got the Medtronic device implanted in my chest February 2006 when my son is only 3 months old. March 2006, was shocked 9 times in less than a minute and was transported by the EMS to the hospital. Was told it was a malfunction and they assured me that it was okay. I was so scared to pick up my son because I thought he would feel the shock if it happens again. No one notify me about the settlement and I just found out today that I am one of the recalls. Today, I contacted an attorney and he told me that I was too late. I am so lost and I guess it is my loss to not be a part of the settlement.

    I ws told there was a revision and now the total is only $220 M (not $268M) because they can't locate everyone.
    But but they put in a stipulation to close in 10 days insstead of continuing porcess for months in the future.

    have'nt really heard anything since january, at that time I was told it would be a few months.
    in April I get a letter saying it would probley be late summer or early fall, but no mention of
    any money amount. Now l find l have to have this piece of metal removed, what can l do or
    who can l call to get some sort of relief to at least pay for any incuring medical bills.

    The Medtronic settlement is a big joke $ 268,000,000.00 for 8,100 clients and 25 who have died. The company is getting away with murder in a grand scale. i was shock at leat 50 times by the bad leads, and spend time in the hospital. The leads can not be removed because I will die, a walking time bomb is what I have become. The offer of
    $ 80,000.00 is nothing, since I have to deduct 33% for attorneys fees. This settlement is a joke on all of us, and the poor people who have die. Shame on Medtronic and their faulty devices. They will take their timemaking the settlement payments, to see how many more people are killed by their faulty leads.
