Family Doctor Botches Cosmetic Surgeries, Malpractice Lawsuits Filed
Eight more women have medical malpractice filed lawsuits in Douglas County District Court in Nebraska against physician Gerard J. Stanley Jr. and SCULPT Contemporary Cosmetic Surgery based in Omaha.
These women join seven others who filed similar claims in back in August. All women have reported suffering from disfigurement, pain, and scarring. Their lawsuit further alleges that Dr. Stanley, who introduced himself as a “board-certified” plastic surgeon is merely a board-certified family physician.
Stanley is not listed as being board-certified by the American Board of Plastic Surgery or by the separate American Board of Cosmetic Surgery. Both specialized certifications require additional schooling and training that Stanley did not pursue. And yet, his website boldly states that the physician is the recipient of the Best of Omaha in cosmetic surgery award, and is at the “forefront” in the field of cosmetic surgery and aesthetics.
Articles of Incorporation for SCULPT Contemporary Cosmetic Surgery filed with the Nebraska Secretary of State’s Office under Stanley’s name back in 2011 indicate that the corporation was organized for the “general purpose of engaging in the practice of medicine and more particularly the practice of plastic surgery.” The Articles of Incorporation for SCULPT have changed since 2011 amid the litigation. “This guy is so misleading, I did my research you guys, I did it,” one woman said.
Attorneys Thomas Shomaker and Thomas Gross of Sodoro Daly Shomaker & Selde in Omaha, who are representing Stanley, stated publicly Monday that their client is a “qualified cosmetic surgeon and he provided proper medical care to each of these patients.” They added that the claims against were submitted by way of a disgruntled employee who was terminated from his business hoping to get revenge.
“We feel the District Court is the proper forum to adjudicate these matters, and these meritless claims will be totally rejected, and Dr. Stanley will be totally vindicated,” the attorneys said.
Fourteen of the women are represented by Omaha attorney James Martin Davis. Five of these clients claim they suffered negative repercussions as a result of cosmetic procedures they underwent in Stanley’s office, including breast lifts, tummy tucks and liposuction. One woman was scarred after the excess skin was removed following significant weight loss. She claims to have suffered nerve damage and continues to have pain in her right arm.
Another patient added, “My belly button isn’t aligned anymore, I have two huge lumps on both sides, left and right side,” while another said, “I mean they’re constantly burning, I have permanent nerve damage in both my arms and he just kept telling me it was going to get better, it was going to get better.”
“I can’t wear swimsuits because my right nipple is so far off it hangs out,” another plaintiff states.
“It’s an unfortunate situation for everyone involved,” said Allison Rockey of Copple Rockey Attorney based in Omaha. She represents the fifteenth patient who was duped into believing in the legitimacy of Stanley’s fake credentials.
