“State Court of Appeals finds Genesys Regional Medical Center culpable in infant’s injury.
McKeen & Associates announced it won an appeal Genesys Regional Medical Center filed against the jury verdict of $2.9 million in a medical malpractice the law firm won on behalf of Libbey Bryson, a Flint mother whose baby suffered permanent injury to her brachial plexus during delivery.
The State of Michigan Court of Appeals upheld the Circuit Court for the County of Genesee’s decision that Genesys’s practicing resident physicians were responsible for the infant’s injury. Bryson, who was suffering from influenza, had her labor induced and shoulder dystocia (when an infant’s shoulder is stuck in vaginal canal) was encountered. The infant suffered her injury due to excessive force and traction during the delivery. Due to the birth injury, the child suffers from severe limitations in strength, range of motion and impairment of manual dexterity. Richard Counsman and Brian McKeen tried the case.
‘Libbey Bryson suffered from gestational diabetes and preeclampsia during her pregnancy’ says McKeen, managing partner of McKeen & Associates, who indicated that shoulder dystocia is more common in delivery when diabetes is present. ‘Given her condition, a more experienced physician needed to attend to the delivery and a C-Section was likely needed as well. Due to the negligence of the residents, the infant now suffers from a permanent injury and will require ongoing treatments. I’m grateful the Court upheld what was the right decision in the first place.’
